Please read these Terms and Conditions before using this website or registering for, purchasing, accessing or participating in a Dragon Lion service.

1. About these Terms

These Terms govern:

  • your use of the Dragon Lion website at dragonlion.com.au;
  • your registration for, purchase of, access to or participation in Dragon Lion services; and
  • your use of Dragon Lion content, digital products, recordings and learning materials.

Dragon Lion services may include coaching, webinars, Masterclasses, courses, practice clinics, workshops, memberships, subscriptions, digital products, physical products, recordings, replays and associated learning materials.

In these Terms:

  • Dragon Lion, we, us and our mean KATACRE61 Pty Ltd (ABN 89 617 310 880), trading as Dragon Lion Consulting;
  • website means dragonlion.com.au and any related Dragon Lion registration, payment or member pages;
  • service means any Dragon Lion service, event, product, program, subscription or resource; and
  • you and your mean the website user, purchaser, registrant or participant.

Our Privacy Policy explains how we handle personal information. Any additional terms expressly stated for a particular service before registration or purchase form part of these Terms. If those additional terms are inconsistent with these general Terms, the additional terms apply to that service to the extent of the inconsistency.

2. Acceptance of these Terms

By using the website, registering for or purchasing a service, or accessing service materials, you agree to these Terms.

Where registration is completed on behalf of another person, the purchaser is responsible for making these Terms available to the participant. Each participant is also bound by the provisions concerning participation, recordings, conduct and use of materials.

You must be at least 18 years old to purchase a service unless we have expressly agreed otherwise in writing.

3. Changes to these Terms

We may update these Terms from time to time. The current version and its effective date will be published on the website.

Changes apply to future website use, registrations and purchases from the effective date. If a change materially affects a service you have already purchased, we will give reasonable notice where practicable and will not apply the change retrospectively in a way that removes rights already acquired, except where required by law or reasonably necessary to protect participants, security or lawful operation of the service.

4. Website use

You may use the website for lawful personal or business purposes connected with learning about, registering for or using Dragon Lion services.

You must not:

  • use the website unlawfully or in a way that interferes with its security or operation;
  • attempt to gain unauthorised access to the website, accounts, systems or materials;
  • introduce malicious code or use automated means to scrape or reproduce substantial website content; or
  • misrepresent your identity or your authority to act for another person.

We take reasonable care to keep website information accurate and available. Website content may occasionally contain errors or become unavailable. Except for rights that cannot lawfully be excluded, we do not guarantee uninterrupted access or that all content will always be complete, current or suitable for a particular purpose.

5. Registrations, purchases and payment

The relevant registration or sales page, order form or written proposal will describe the service, its price, key inclusions, delivery method and timing, together with any access period that applies.

Prices are stated in Australian dollars and include GST where applicable, unless otherwise clearly indicated. You must provide accurate registration and contact information and ensure that you are authorised to use the chosen payment method.

Your place or access is confirmed when payment has been received, or when we confirm a free registration. If a pricing or availability error is identified before delivery, we will contact you and offer the option to proceed on the corrected basis or receive a refund of any amount paid.

Payment may be processed by a third-party payment provider. We do not store full payment card details on our own website systems.

6. Delivery and access

Digital products and access instructions are delivered to the email address supplied at registration or made available through the relevant platform. Please check your spam or junk folder and contact us if expected access information has not arrived.

Any access period or replay availability stated for a service applies to that service. If no period is stated, access will be provided for the period reasonably associated with supplying the service and may depend on the continued availability of the relevant platform. These Terms do not promise permanent access. You are responsible for accessing or downloading materials within any stated period. We will provide reasonable assistance with access problems that you report to us.

If we offer physical goods, delivery timing and charges will be stated at purchase. Please contact us if an item is lost or damaged in transit so that we can investigate and provide any remedy required by law.

If an event outside Dragon Lion’s reasonable control prevents or materially delays delivery of a service, we will contact affected participants and take reasonable steps to reschedule the service, provide a suitable alternative, extend access or offer another appropriate remedy. Nothing in this paragraph limits a right or remedy available under the Australian Consumer Law.

7. Cancellations, transfers and refunds

Unless different terms are stated for a particular service before purchase, the cancellation, transfer and refund provisions in these Terms apply.

Under these general Terms:

  • a change-of-mind refund is not automatically available for a digital product once it has been supplied or accessed;
  • a change-of-mind return or refund is not automatically available for a physical product that meets the consumer guarantees, unless different terms were stated before purchase;
  • non-attendance at a live session does not automatically create a right to a refund where the purchased package includes a replay or other materials; and
  • you may contact us before a live session to ask whether a transfer to another available date or participant is possible.

We will consider reasonable requests in light of the nature of the service, notice given, access already provided and any costs already incurred.

If Dragon Lion cancels a paid live service and does not offer a suitable alternative, you may choose a refund of the affected amount paid or a credit toward another service. If we reschedule a service and the new time is not reasonably suitable for you, contact us and we will offer an appropriate transfer, credit or refund for the affected component.

Nothing in this section limits any right or remedy available under the Australian Consumer Law. Where a service or product does not meet an applicable consumer guarantee, the remedy will depend on the circumstances and the seriousness of the failure.

8. Subscriptions and memberships

Where a service is supplied as a recurring subscription or membership, the billing frequency, price and inclusions will be disclosed before purchase.

You may cancel future renewal using any cancellation method provided with the service or by contacting us. Cancellation stops future charges but does not ordinarily result in a refund for a period already supplied, subject to the Australian Consumer Law and any different terms stated before purchase.

We will give reasonable notice of a material change to subscription pricing or inclusions. If you do not accept the change, you may cancel before the change takes effect.

9. Educational and professional development purpose

Dragon Lion services provide general education, coaching and professional development. Information, examples and activities are intended to support your own thinking, judgement and choices. They do not constitute legal, financial, medical or other regulated professional advice and may not be appropriate for every workplace or situation.

You remain responsible for:

  • the decisions you make and the way you apply the material;
  • determining whether the material is suitable for your circumstances;
  • obtaining any necessary organisational approval or authorisation; and
  • seeking advice from an appropriately qualified person where required.

Learning and coaching outcomes depend on many factors, including participation, circumstances and implementation. We do not guarantee a particular employment, career, business or organisational result.

10. Coaching services

Coaching supports reflection, learning and decision-making. It is not counselling, therapy, legal representation, recruitment, financial advice or a substitute for services provided by an appropriately qualified professional.

If additional scope, confidentiality arrangements, scheduling conditions or records practices apply to particular individual or organisational coaching, they may be set out in a coaching agreement, written proposal or service information.

11. Working safely with workplace information and AI

When using workplace examples or AI tools in connection with a Dragon Lion service, you must:

  • remove names and identifying details unless their use has been expressly authorised;
  • avoid disclosing protected, classified, personal, confidential or commercially sensitive information;
  • use only tools and information permitted by your organisation;
  • follow applicable workplace policies, professional duties and legal requirements; and
  • review AI-generated material for accuracy, suitability, assumptions and possible consequences before relying on it.

Do not enter another person’s personal information into an AI tool unless you have a lawful and appropriate basis to do so.

You remain responsible for information you choose to disclose or enter into an AI system. The security, storage, training and data-handling practices of third-party AI providers depend on the provider, account, settings and service in use. You should review the applicable provider terms and your organisation’s requirements.

Dragon Lion may use AI-assisted or transcription tools in delivering or administering services, including for ordinary administration, preparation, communication, analysis and production. These tools may process personal information as described in our Privacy Policy. We will provide additional information or seek permission where the use is materially different from what a person would reasonably expect, where the nature of the service makes this appropriate, or where required by law. A separate notice is not required for each ordinary administrative use.

12. Participation in live and group sessions

Dragon Lion sessions are designed to support active professional learning. You may participate in discussion, chat, private workbook activities, shared examples or your own suitably generalised work.

You are not required to disclose your own workplace material, speak, appear on camera or discuss a personal situation in order to participate. You may work privately or use an example supplied by Dragon Lion.

When contributing to a session, you agree to:

  • communicate respectfully;
  • avoid disclosing information that cannot safely be shared with the group;
  • follow reasonable facilitator directions intended to protect participants and support the session; and
  • avoid conduct that materially disrupts the learning or infringes another person’s rights.

We may mute, remove or restrict a participant where reasonably necessary to protect participants, privacy, security, intellectual property or the effective delivery of the service. Where appropriate, we will first explain the concern and provide an opportunity to address it.

13. Participant contributions and group privacy

Participants may share professional experiences to support learning. You must treat other participants’ contributions with care. You must not repeat, publish or attribute identifiable details outside the session without the person’s permission.

Dragon Lion cannot guarantee the confidentiality of information a participant voluntarily discloses in a group setting. Participants should remove identifying details, generalise examples and avoid sharing information that cannot safely be discussed with the group.

14. Participant recording, photography and transcription

Unless Dragon Lion gives prior written permission, participants must not:

  • make an audio, video or screen recording of a session;
  • photograph, screenshot or otherwise capture another participant or their contribution;
  • create or retain an automated transcript of a session;
  • introduce a recording, transcription, note-taking or meeting bot into a session; or
  • distribute or publish a recording, transcript, image or substantial reproduction of a session.

Any permission may be subject to conditions and to the agreement of other people who would be recorded or captured.

This restriction does not prevent you from taking ordinary personal written notes that do not reproduce substantial parts of the session materials or capture another participant’s identifiable information.

15. Official recordings and replays

Dragon Lion may make an official recording of a session. Where a session will be recorded, participants will be informed before the session or at the beginning of the session. This may occur through the service information, registration or confirmation material, a platform notice, an opening slide or a verbal explanation.

The information provided will be appropriate to the session and may explain:

  • who will receive the complete recording;
  • whether participant voices, images, chat contributions or workplace examples may be included;
  • whether a separate edited replay may be distributed or sold;
  • how participants can contribute without sharing their own workplace material; and
  • whether participants can ask for the recording to be paused or a contribution to be excluded.

By choosing to contribute while an official recording is in progress after the recording arrangements have been explained, you agree that your contribution may be included in the recording for the stated audience and purpose. If you do not wish to be included, you may use any non-recorded participation options explained for the session or contact Dragon Lion before contributing. You may ask whether the recording can be paused or a contribution excluded. Whether this is available will depend on the session format and what is reasonably practicable. If Dragon Lion agrees to an exclusion request, we will take reasonable steps to apply it before distributing the relevant replay.

Dragon Lion may edit a recording to remove participant discussions, workplace examples, personal information, interruptions or material unsuitable for wider distribution. An edited replay may therefore differ from the live session.

You must not share your access to a recording or replay with anyone who is not entitled to receive it.

16. Intellectual property and permitted use

Unless otherwise stated, Dragon Lion or its licensors own the intellectual property in the website, teaching content, methods, branding, slides, workbooks, worked examples, templates, prompts, recordings, replays, digital products and other service materials.

Subject to payment and these Terms, you receive a limited, non-exclusive, non-transferable licence to use the materials supplied to you for:

  • your personal learning; and
  • your own internal workplace application.

You may print or download materials where that function is provided. Unless Dragon Lion gives prior written permission, you must not:

  • copy or distribute materials to other people;
  • share logins, download links, recordings or replay access;
  • upload or use substantial Dragon Lion materials in a shared or reusable repository, public platform, shared AI knowledge system, model-training dataset or similar system that enables other people to retrieve, reproduce or reuse them;
  • republish, sell or commercially exploit the materials;
  • use the materials to provide coaching, consulting or training to others;
  • remove copyright, branding or attribution notices; or
  • adapt or represent Dragon Lion materials as your own product or intellectual property.

You may apply ideas and practices in your own work and combine your learning with your own professional knowledge, experience and independently created material. You may also store and use reasonable working copies in an access-controlled internal workplace system where this is reasonably necessary for your permitted internal workplace application. This does not permit you to make proprietary Dragon Lion materials available as a general organisational training or knowledge resource, use them to train or fine-tune an AI model, or enable other people to reproduce or reuse them.

These restrictions protect the reproduction and redistribution of Dragon Lion materials. They do not claim ownership of your experience, your workplace information or your independently created work.

17. Your material and contributions

You retain ownership of material you create and workplace information you bring to a service.

If you voluntarily provide feedback, questions or general suggestions, you permit Dragon Lion to use them to improve its services, provided we do not identify you or disclose confidential information without permission.

We will not use an identifiable participant story, testimonial, case study or workplace example for marketing without permission.

Any use of a participant contribution in an official session recording is governed by section 15 and the recording arrangements disclosed for that session.

18. Privacy and service providers

We handle personal information in accordance with our Privacy Policy and applicable privacy law. The Privacy Policy explains how we collect, use, disclose and store personal information and how you may contact us about a privacy concern.

We may use third-party providers for website hosting, email, payment processing, video conferencing, community platforms, file storage, scheduling, transcription, AI assistance and service delivery. Those providers may process information under their own terms and privacy practices.

We do not sell personal information. We may disclose information where reasonably necessary to provide a service, administer our business, comply with law, enforce an agreement or protect the rights, safety or property of participants, Dragon Lion or another person.

19. Third-party platforms, tools and links

The website and services may include links to, integrations with or use of third-party websites, platforms and tools. A link or reference does not necessarily constitute endorsement.

Third-party services are governed by their own terms, privacy practices, availability and technical requirements. To the extent permitted by law, Dragon Lion is not responsible for third-party content or for a failure caused solely by a third-party service outside our reasonable control. If a third-party issue materially affects access to a Dragon Lion service, contact us and we will take reasonable steps within our control to assist.

20. Consumer guarantees and limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

To the extent permitted by law, Dragon Lion is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by your unauthorised, unlawful or inappropriate use of the website, services, AI tools or materials.

Where the Australian Consumer Law permits liability for a failure to comply with a consumer guarantee to be limited, our liability may be limited, at our option, to supplying the relevant services again or paying the reasonable cost of having the services supplied again. This limitation does not apply where it would be unlawful or where it would be unfair or unreasonable in the circumstances.

21. Suspension or termination of access

We may suspend or terminate access to a website account, service, community, recording or materials where reasonably necessary because of:

  • non-payment;
  • unlawful, abusive or materially disruptive conduct;
  • a serious or repeated breach of these Terms;
  • unauthorised recording, distribution or misuse of materials;
  • a security, privacy or safety risk; or
  • a legal or platform requirement.

Where appropriate, we will provide notice and a reasonable opportunity to address the concern. Any refund or continuing access will be determined having regard to the circumstances, services already supplied, these Terms and rights available under the Australian Consumer Law.

22. Concerns and complaints

If you experience a problem with the website, a purchase or a service, please contact us at info@dragonlion.com.au. We will review the concern and seek to resolve it fairly and within a reasonable time.

Privacy concerns will be handled in accordance with our Privacy Policy. If the Privacy Act applies to the matter and you are not satisfied with our response, you may be able to make a complaint to the Office of the Australian Information Commissioner.

23. Governing law

These Terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia.

The parties submit to the courts and tribunals that have jurisdiction in the Australian Capital Territory, subject to any right you have to bring a claim in another jurisdiction under applicable law.

24. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or removed if it cannot be read down. The remaining provisions continue to apply.

25. Entire agreement

These Terms, together with any additional service terms expressly stated before registration or purchase and any applicable written agreement, form the agreement between you and Dragon Lion concerning the relevant website use, registration, purchase or service. Our Privacy Policy applies to the way we handle personal information.

Nothing in this section excludes any term, guarantee, right or remedy that applies by law and cannot be excluded.
